1. A recess of half hour is included in the 8 hour per day or excluded.
2. Is anything more than 8 hours per day is OT?

Hello friends

Would the laws regarding work hours limitation be applicable to employees only or same would be applicable for consultants too?

A close friend of mine is working as a consultant doctor. They have a six day week, with one of the days being a half day (5hrs). Now her health centre has decided to increase their working hours as below:
i) if working on sat sun, works hours : 10 am to 9pm (no O.T.)
ii) if working on public holiday, work hours : 10am to 9pm (no O.T.)
iii) also, every consultant has to work the 10am to 9pm duration once a week (apart from sat/sun).
iv) OT and comp offs that were awarded earlier for (i) and (ii) resp., have been withdrawn.

The health centre does not provide any kind of transportation to female employees nor consultants who work beyond 7pm.

This management decision has left many of them disheartened. They really are left with no time for family, especially married women... :'(

Then again, if one calculates, each consultant/employed doctor is working for anything between 53 to 56 hours per week wiothout any o.t. or comp. offs.

Is this appropriate treatment of consultants?

This is sad. Now days are coming when the majority patients of doctors would be other doctors.
This is a sheer mechanism to sqeeze out the last juice from the life to earn more and more on the part of the management and employer.
But what would be the consequesnces?
Let me guess,
Step1 :Doctors would soon drooze while in Operation Theatre, prescribe wrong medicine and soon would leave their cellphone inside operated organs.
Step 2: Performace loss on the part of doctors
Step 4: Doctors would do some mistakes, public would suffer
Step 5: Public would complain
Step 6: The reputation of Doctors and the institute would be at stake
Step 7: NO PUBLIC GOOD, huge income on the part of the employer. many tragic mis-treatments, a few deaths - who cares!
MONEY MONEY MONEY MONEY MONEY MONEY...
I Hope and pray The management and the Institutes get BANNED soon because of all these approaches to earn more and treat theier employees as dogs.

Hi,
I am working in construction company.
As per our company rule we need to :
1. work 76 hrs minimum in a week
2. Each day of 7 days (Sunday half)[FONT='Verdana','sans-serif']we office hours 12 hours or more since 30 minutes of recess is deducted from the work hour.
[FONT='Verdana','sans-serif']3.Does this violate any Law or norm?
I have heard that 48 hours a Week is the limit and 9 hours a day. IS this true? So can we ask to Pay Overtime?
I am also keen to know whether recess time is inclusive of daily work-hour?

Hi,
Don't wory if requirement the organisation then they do extra working in the organisation. 1st If you not show the records for OT then can pay the money to employee as per company written or unwritten rules (as per the management).
If you are showing the actual over time in the company so that you can pay the double overtime to employees and make a register "OVER TIME REGISTER" is the mandatory for the statutory requirement.

Hi All,

In India the legal working hours in a week is 48 hours and the maximum can go upto 60 hours.

Overtime has become a policy of the company, Overtime is a stone age concept and usually associated with workers and is for people working in factories. Overtime was introduced because of lack of skilled labour or the company not being able to accomodate more than certain amount of people in their payrolls.

The liability of employers has been reduced over the last 10 years and hence offices have been given the option of not including overtime into their policy and instead increase the number of employees thus promoting more employment opportunities.

The 48 hours does not include the lunch break of 1 hour if it is distributed over a six days week. The employers recently have started a trend of having five days week and hence it is distributed as 10 hours per day, this includes the lunch hour too but if required the employees are asked to stay back.

Although I can understand the concerns of IT employees or all those guys who work under project deadlines, they are asked to work for longer hours but since the overtime policy doesnt exist, the company here is supposed to appreciate the extra hours put in when declaring bonus for the employees and this is valid legally. If an employee contests legally citing putting extra working hours and the company has paid a fair bonus the case is considered in the employers favour.

Dear Mr Choudhury
48 hrs a week is the rule.
Excludes Lunch break.
In other words, one can get 48 hours of actual work a week.
It is as simple as that!!!
How much we actually work the Director works, work life balance are immaterial to your query hat is a different subject altogether
