Just wanted to know if there is any legal / statutory aspect in hiring Summer Trainees for 2 months.
Also, how should the payment ( stipend ) be made to summer trainees?
Appreciate all your help.

Yes it is there if they are trade/vocational trainees. They are covered with Apprentices Act, 1961.

The provisions of this Act are not applicable to any area or to any industry in any area unless the Central Government by notification in the Official Gazette specifies that area or industry as an area or industry to which the said provisions shall apply with effect from such date as may be mentioned in the notification.

It also cover graduate or technician apprentice that means an apprentice who holds, or is undergoing training in order that he may hold a degree or diploma in engineering or technology or equivalent qualification granted by any institution recognised by the Government and undergoes apprenticeship training in any such subject field in engineering or technology as may be prescribed.

Technician (vocational) apprentice who holds or is undergoing training in order that he may hold a certificate in vocational course involving two years of study after the completion of the secondary stage of school education recognised by the All-India Council and undergoes apprenticeship training in any such subject field in any vocational course as may be prescribed.

Trade apprentice who undergoes apprenticeship training in any such trade or occupation as may be prescribed

Management trainee who is engaged by an employer for undergoing a course of training in the establishment of the employer (not being apprenticeship training under this Act) subject to the condition that on successful completion of such training, such person shall be employed by the employer on a regular basis.

There is a provision to pay stipend (amount varies time to time) to above trainees.

Hi Mansi,
Hiring Summer Trainees has no legal aspect. But make sure that u take necessary approvals before u proceed with this program.
The payment made in the form of Cheque is a better idea legally.

Dear Mr. Arvind Singh,

We are taking Summer trainees from various Management Institutes / Engineering Colleges / Universities purely as per need basis/ requirement of the depts./ Organization.

These students are pursuing their studies & as part of their Curriculum, they are supposed to take “ on the job” training so that their learning become effective.

They are generally available during “ summer “ only, undertake practical training under the supervision of our depts. representatives known as “ Industry Mentors “ as well as the concerned Professor of the Institute/ university. These students are given different projects / assignments keeping in mind their specialization, be it in marketing / sales / finance / human resource / supply chain management / information technology etc. Depending upon the nature of Projects / assignments, they do perform desk as well as field jobs within this stipulated period of two months.

On completion of their summer internships, they submit Project Report which are duly evaluated as per the guidelines framed by the Institute / University as the case may be.

whether the Stipend paid to these SUMMER TRAINEES will attract ESI / EPF Act ( s ). Our company has not sought permission from the Apprentice Advisor under the Act.

Seemaa
