Hi
I am working with one US based but owner driven company. I have good repute in company. My appointment letter says that I have to serve 30 days of notice period.
But while giving one salary rise they compulsarily took signature from everyone making us agree for 90 day of notice period.
Now when I have given resignation they are not ready to accept it. I am ready to serve for 30 days without pay, and I have 29 day of paid leaves balance.
One more thing is I signed a bond with the company when they sent me abroad. That bond will also get over in next three months. That is I put my papers when I am short of three months to complete my bond period. SO that my bond period and notice period ends at same time.
In this circumstances can they hold me back? They are saying that they will not give me relieving letter. But I need it to join new company.
Pl. suggest. what to do?

Dear SJ
Please view this from the angle of management that , they have sent you to abroad and your company must have spent certain amount on this account. Naturally, they may expect you to be with them for certain period and contribute your acquired knowledge, for which you have been deputed to abroad. If you resign before the period, then it is quite natural, that they may not accept your resignation and may not issue your relieving order too.
If you have a good repute in your company and have ready to work for 30 days w/o pay, and also having a leave balance of 29 days, you can easily discuss with your superior. Convince them the situation and circumstance forcing you to be relieved before the notice period.

Hi Joshi.. I too suggest and endorse Mr. L Kumar's views. You have not mentioned about your new employer... are they based at US or in India. You can adopt a different approach if if your new employer is based out of India.

Shirish, What Kumar said is the other part of the coin, no doubt he is absoulately right from management's angle. in this situation u can do one thing just meet to HR head and explain him/her the casues that are forcing you to take this decision. If the problems are personal and genuine no one will/can/should stop you.
If it does't work tell the this critical situation to management of ur new venture and let them take decision.
