Dear Bharat Shah, As you are employing less than 20 employees in your establishment this Act is not applicable to you & therefore you are not to give bonus under this Act of 1965. Regards, R N KHOLA

Dear Jeeva
Yet it is true that the Bonus is applicable after 5th year, This is statutory/mandatory. but it is at the company's discretion to pay the bonus even earlier period.
If any employees Basic+DA is morethan 10,000.00 there is no need to pay the Bonus as per the Act, still if management wishes to pay then there is no restriction & company can pay as per their earnings. Please note for Bonus calculation only Basic+DA need to be counted & not the Gross which includes the HRA, CA, LTA, etc.

Hello All....
I have one problem...
I recently resigned from my last company. They paid me Bonus 3500 for Last financial year and NIL for this year.
I attached file here
My point is, they told me that Bonus is at 8.33% if you resign from company. But they even didnt gave me that too. They told me upper band is 3500/- pa. Is it so??
One more qn is, they mentioned in letter that min rate of bonus is 8.33% and 11.67% is variable. Variable is dependent upon Performance. Now bonus is paid as per company performance, right?? Then I should get that variable amount too, ofcourse when they announce rate of that variable.
I need help from you all guys. Please mail me at
