i put in my papers in a software company that i currently work in on 20/02/2008. The HR policy of the company clearly states that an employee may leave the company after serving a month's notice or by buying the notice period if the supervisor agrees. so 30 day's notice ends on 20/03/2008 which i'm willing to serve.

However, strange as it may sound, my supervisor is unwilling to relieve me before 31/03/2008 thereby demanding a notice period of 41 days. Now, my next employer is not ready to take me in after 28th.

can i take legal action against my company ? if so, how ?

i even consulted the HR (she acknowledged that there exists a 30 day notice period) who said that its better to take supervisor's approval. when queried whether i would get the relieving letter after 30 days, she simply blew away the topic.

pls advise and inform me of my rights to recieve relieving letter. !!

also, i've enjoyed a hassle free 3 year relationship with my current employer but ever since i've resigned, I'm made to look like an offender !

Hi, if u are serving notice period as per company rules no employer can stop u from going after that day. but first understand why ur employer wants u to be there till that date. have they not found a replacement or is that handover period not enough. request them if u can come on holiday or after office hrs to do a proper handover.
pls ensure that u have ur resignation documented with a proper date. also ensure that u mention ur willingness to serve notice upto so and so date which is as per company policy. No company can stop from giving u relieving letter if u have abide by the rules.

You hv good service record and name with ur present employer, this is important. Don't try for legal remedy.
I don't think it is difficult to get changed ur joining date from 28th to 1st april, better try only that.
Walk out of ur present company with relieving order and problem free good employee.
