If we find out that our HR Dept is indulging in Corrupt Practices, and unethical harassment of employees. Where can these be complained. What if the HR Dept is not transparent in recruitments and appraisals. How can the data regarding recruitment of a company be obtained from the HR Dept. Is there any authority above HR which is not partial towards HR, and would abide by the law.
Can a direct police complaint be filed against them?
In this case even the TOP MANAGEMENT results in supporting the HR Dept.
Can we directly drag the concerned HR Executive / Manager to the Court, and demand compensation for HARASSMENT.

HR is not god or almighty in the organisation.
HR is just a process as marketing or finance or purchase or any other function.
If you are affected by any one in the organisation, and if you are personally affected, then you must raise it to your boss. You can not go to police. Excepting for Sexual harassment, police has no role to play in an organisation.Of course violence is another area.
IF someone takes bribe, from you, and if you pay, both are guilty of the offence.and action could be taken under the service rules or well accepted employment law. But definitely not covered by any Indian Penal Code.
One last word.
Dont blame only HR. No recruitment is completed by HR. Final decision to select a person, solely rests on the concerned department. Even if your allegations are true of your organisation, then it is just not HR who are indulging, but it is the entire organsiation which is involved.

You did not mention, what type of corrupt practices HR Deaptement is involved into ? If my guess serves me right then probably, HR Manager / Recruitment personnel is taking some percentage of total value of the billed amount from the recruitment agencies against the recruitment of the cadidates referred by them or even directly from the candidates for providing them employment in their organisation. If this is the case, you can blow the whistle with the help of affected persons and bring it to the notice of the top management (all Directors and MD). In this case, if you provide some solid eveidences, I am sure, this matter would be investigated thoroughly and culprits punished appropriately.

Police can intervene only when the affected person /s lodge /s the complaint regarding this unfair practice. However, I suggest that you seek guidance from a good lawyer before resortng to this action as the person who gives bribe is also equally as guilty as the bribe taker.

Further, if there exists such a dirty culture in your company where HR Department has a support of the Top Management, I think nothing can be done as, in my opinion, Top Management also seems to have been "taken care of" by the HR Manager.

Changing the job, could be one of the better options. However, tolerating injustice is nothing but the act of cowardice. I think, if you have the support of your colleagues then wage the war against those HR personnels with full force and weed out those corrupt officials.

However, while doing so, you need to be preared for the worst as in a company like yours, such an action would have severe fall out which may not be in your favour. Please proceed ahead only when you are 100% sure that the Top Management is to be relied upon and trusted.

If you find the HR Department indulging themselves in corrupt practices you can report the same to your lead manager and further he can take up the case with higher management. In case of any unethical harassment against any employee, the aggrieved employee can submit an application to the management (through proper channel) for Redressal of Grievance, the system which may normally available in the organisation.

What if the HR Dept is not transparent in recruitments and appraisals.

The Recruitment process is not a single man show which is being dealt only by the HR. The management team might have been involved in the process of recruiting. Further the HR must maintain the confidentiality on the Recruitment and appraisals procedure. You cannot expect that it can be published openly to everyone in the office and if the appraisal details is given open access then it will damage the morale of the employees.

How can the data regarding recruitment of a company be obtained from the HR Dept.

The recruitment data can only be given to the Government Employment exchange and it will not be given to anyone.

Yes. You can approach the Labour Officer/Court of Law for any injustice regarding your salary pending/under payment/non payment and any other HR Related issues.

NO. You cannot directly approach the Police, without proper approach through your office various redressal grievance mechanism.

What is your case? Where do you face problem? Do you want to deploy your recommended candidate? If you are working upto the satisfaction of your management where did you face problem in getting a good appraisal? Have you ever analysed about why the Top Management is supporting the HR and not you?If you do so, then what is the outcome of your analysis? Why you have not getting convincing with your analysis?

You can answer the above question within you and try to get the answer within you.

Further if you feel you are not convinced with the act of HR then you discuss with your immediate Boss and further to your top management to find out the solution

What was the harassment you faced. You have not disclosed about your issue here. If you are a female and you are being harassed sexually, then you need not to go through several procedures and you can directly approach the Police authorities and drag the HR to Police Station and further followed to Court of Law.

My dear friend
How about this case, where by someone has applied for a job, was sellected for a interview process was successful on the interview signed a contract. But afterwards the person is told that he can no longer get the job ,because some one who knew the HR representative and also knew the candidate from else where bad mouthed the candidate character falsely and unfairly to HR rep stopping the candidate to get the job. All because the candidate and the person who knew the HR Rep did not get along in the past. The candidate references was not contacted or used at all. Plus now the Candidate was band from applying for any job that company oferrs because of this false lies. How can this case be tackled? Help please!!

Your query is not clear. I will give the details what I understood from your post. If it is correct, then please do inform, then our members will give the suitable reply.

1. Mr. X applied for a job and selected and all the joining process are completed and the contract also got signed by both the parties. But Mr. X did not join.

2. After completion of all the process by Mr. X, the HR Representative influenced the management and made Mr. Y for the same vacancy.

3. On Background Verification it Is revealed by HR that Mr. X was blacklisted and banned from applying for job. Hence the HR Department selected Mr. Y for the said vacancy.

Hope this is the case. Further please do inform what is your query. In which way you want to tackle. (1) Are you trying to get the appointment for Mr. X? or (2) Are you interested to drag the HR/Management for not fulfilling the contractual obligation, which Mr. X signed?
