I am working in manufacturing co. in hr department (welfare and IR). now we have 29 ladies employees including contract, trainee, permanent and we r going to recruit three more female employees. but out of 28 4- 5 employees are in age 54 - 58. so i want 2 know that if we recruit these three female employees the Creche Provision will be applicable or not and we dont want to start creches - please guide us whether we recruit them or not?

If there is working 30 or more female employees creche should implement. If there is any private creche is locate nearby on your factory you can get an agreement with them, then you can approach Inspector of factory to get Exemption from Creche certificate.

Creche is mandatory for those Factories employing not less than 30 WOMEN workers. Here the age of the worker is not a matter. Even if the women employees all together have no child to be kept in the creche, it is compulsory to maintain it. The Plantations Labour Act is more specific in this respect. Under the PLA, creche is required where the number of women workers exceed 50 OR THE NUMBER OF CHILDREN OF women workers EXCEED 20.
Any way, have a creche just to avoid penalty.

I reproduce below Sec 48 of the Factories Act
48. Creches. -
(1) In every factory wherein more than [thirty women workers] are ordinarily employed there shall be provided and maintained a suitable room or rooms for the use of children under the age of six years of such women.
There are liberal interpreatation taken by different inspectors. I have come across with inspectors taking Married woman count and also age of the woman employees
They are more practical I cant give guarantee about legality
But if the age group of woman employee's children is above 6, you can take a stand that you do not need to have a creche.The law anticipates atleast 30 children to be maintained
Just examine the age group of woman employees' children We may get a reasonable solution to the problem. I can suggest a method
