Dear friends ,
Please let me know if any accident takes place in a factory with any worker,what legal steps i have to take? i mean i heard i have to inform to Factory Inspector etc ? what else one has to do?
Please let me know the detail procedure .

Dear sender
Immediate notice to be given to the nearest police station, then to factory inspector, and then to ESI if applicable. and to be substantiate the accident with doctors bills and treatment (if it is major)
In case of minor, then these procedure is not needed. Only written informatin to factory inspector and can render medical treatment as per your company's policy.

if the accident happens then you have to intimate 1st to factory insector then esi inspector, then police station, within 48 hrs.
then submit the accident report to factory insector, esi inspector

Hi Rajeev,
Actually Their are two diffrent situations for the accidents
Minor
Fatal/Major
In case of Minor acident u just need to fill form No. 16 of ESIC and forward it to ESIC dont forget to make a entry of the same instance in ur accident book format prescribed under ESIC & factory act rules. at the same time u need to inform the factories inspector.
on the other hand In case of Major/fatal accident the first & Immediate step is to inform the Nearest Police Station & Family of the Individual. Next fill the Form No 18 of ESIC and adopt the Same Procedure.

Could you please describe on accident
If it is serious/fatal police , factory inespector concerned authority to
be informed.
If it is minor, it has to be treated and rest period to be borne by the company.
safety department will initiate the action to find out the exact cause of accidnet and to ensure should not happen in futire.(countermeasure)

When an accident takes place, the primary responsibility of the employer is to give him first aid. Then he shall be sent to medical dispensary or hospital depending upon the fatality of the accident. Normally, workers who are covered under the ESI will get treatment from the nearby ESI Hospital.
The next formality is to inform the Inspector of Factories and Boilers and the ESI local office of the accident. This is done by using proper forms. That is, Form 18 (Notice of Accidents and Dangerous Occurences)is to be sent to the Factories & Boilers and a similar form- Form 16- to be sent to the Local office of the ESI to which the company is attached.
The particulars of the accident should also be entered in separate registers kept as-
Accident Book- Form 15 - ESI and
Register of Accidents and Dangerous Occurences in form 26- Factories Act.
This facilitates cross checking.
