Can we hold back the salary during probation?
Hi i have an urgent query . in our organization management wants to implement a rule while recruiting candidates. salary would be mentioned in the offer letter/ appointment advice with a ratio of 25 basic including allowance and 75 as the incentive 10000/salary30000/ incentive for one sale. in case he dose 2 sale then the amount will 60000/ and so on . it would also further mention that during the probation period one month will be treated as the lead time during which the 25 of the salary will be released even if the employee dose not do any sale but from the next month in order to release even the 25 he has to do a minimum of one sale . management will only pay if he performs . now my contention is can we legally or as per hr policy implement such thing in writing?

One finance institution has head office and branches in kerala they have also branches in many states in india. my query is whether the appropriate government with regard to payment of gratuity act 1972 is central government. the definition section 2aib states it is central government. however one of the controlling authority in kerala remarked that some of the court judgment is against it. so i want some of the court judgement stating the shop and commercial establishment having branches all over india the appropriate government is central government. please give a clarification and court judgments.
