Wish you all a very happy and healthy New year, i have recently joined a software company and my seniors have told me to make an study of consultancies operating in pune? how much they charge on each candidate place?, what will be the terms and conditions if candidates leaves the company within 3 months? and so on.....
In short i require standard terms and conditions for consultancies particularly in I.T sector.

Below are list of the terms & condition for IT Company.

Our Terms & Conditions (Recruitments)

Once the candidate is selected, the detailed breakup of the Annual CTC offered should be made available to us within three working days of release of the offer.

Recruitment charges for the selected candidates will be @ 8.33% for Jr. Position & 10% for Sr. Position of the Annual CTC.

Service Tax will be extra, and will be charged on the invoices as per the notification given by the Govt. Of India.

The invoice will be raised within a week from the date of joining of the candidate.

All the payments to be made within 30 days from the date of joining of the candidate.

Incase the candidate selected through us leaves your organization on his own accord within 90 days; we will provide you with free replacement, for once only.

Quest Consultants would do all communications with the candidates.

We will maintain confidentiality of your organization relating to recruitment at first priority. And visa versa.

Here is an agreement. Please go through it. We think, this is the better one.


First Part : Company

Second Party : Consultant

1.Services: The second party will provide the suitable candidates for the requirement of job with the first party.

2.Eligible candidates for which the service charges will be payable by the first party:

a.only the candidates who have not applied with the first party.

b.candidate not within the data base of candidate of the first party.

3.Terms with the candidates:

a.Candidate upon the selection for any of the position; will have to sign an agreement with the first party to serve at least 1 year.

b.Breach of agreement attracts a liability of Rs 50000.00 (Rupees Fifty Thousand Only)

c.Payment under (b) above is secured by 5 advance cheques for Rs 50000.00 in favour of first party.

4.Non Disclosure of information:

a.second party will not disclose the information relating to the process of recruitment, selection of the candidates through word of mouth or any other means to the third party or any of the party.

b.any other information relating to the first party that can affect the fem of the business and/or the working of the first party shall not be discussed or shared with the third party or any of the party.

5.Restriction clause:

a.That the second party will not influence in the selection process of the first party in any manner.

b.That the decision of the first party regarding the selection of the candidate would be final and no question will be entertained in this regard.

c.That the second party will neither interact with the employees of the first party nor entertain them in any matters.

d.That the second party will not relocate or place any of the employee of the first party for a minimum period of one year from the date of this agreement.

6.Amount of service Charges:

50% of the of the first month’s gross salary of the candidate selected through the second party.

7.Payment of service charges:

a. Second party will serve a proper invoice of the service charges.

b. First party will release the 50% of the payment due in 15 days.

c. Balance 50% of the payment due will be released after 30 days from the date of joining of the candidate.

d. TDS will be deducted from the payment due; as applicable under the Indian Income Tax Act, 1961.

e. The overall limit of services charges is Rs 25000.00 in any case. In order to avoid the confusion, if the whole or part of the positions vacant closed by the consultant, the service charges for such bundle vacancies will not be exceeding Rs 25000.00 ( Rupees Twenty Five Thousand Only).

8.Replacement of the candidate: Within 30 Days

a.If the entry level candidate resigns from the services to the first party within a period of 30 days;

b.If the Juniour Middle level candidate resigns from the services to the first party within a period of 60 days;

c.If the Middle level candidate resigns from the services to the first party within a period of 90 days;
