Hello, my name is Veda. I got married in Jan 2024, and my husband passed away on December 28. He met with an accident now, and in his portal, our marriage details are not updated. I informed one of his teammates his team, and he informed HR, but HR called his mother as she is the nominee. Can I get any benefits from the office? If I mail it to HR? And what is the further process?

It is very unfortunate.
You may send a request to the office attaching the marriage certificate. Let the Company stop paying the gratuity amount to mother whose name appears in the records. The HR cannot take a stand that the employee did not update his profile, if the marriage was known to the HR, he should have proactively done the changes in the family details. The HR is meant for such things also. You may also send a communication to the EPFO claiming to be the legal heir of the deceased.

You should meet the HR Manager (whoever is heading the Human Resource team) personally and discuss the matter. If the marriage was officially communicated, the HR should have initiated to collect fresh nomination (form F) for Gratuity and also advised the employee to do the necessary changes in the EPF portal. therefore, let them take it forward.

Ya I understand but the thing is I don’t know any hr manager or anyone from his office Becoz as it a wipro I didn’t even have any leads and I cannot go to the office in person now whom should I mail or how can I get in touch with someone from the company

Why do you hesitate to go and meet the officials in Wipro? Why should not Wipro disallow a person from outside? It is a wrong perception that Wipro and companies like Wipro will not allow anyone to get in for any discussion. Afterall, you are not going to create hurdles to their duties, but you are going there because you have the right to go there and ask about the employee who was there in their service. Moreover, the said employee was your spouse. I would say that they should have come to you and discussed the matter much earlier. Now, when you go there, you should also appraise the same.

You meet the DLO/ALC/DLC of your area Or area of Wipro to raise your complaints. The HR is not the authority to decide the legal heir. The DLO/ALC/DLC will call the HR. You can send a copy mark to Wipro. You need to move through a lawyer.
