Hello, we are a construction company in Mumbai, Maharashtra.

One of our employees came to the office on a public holiday, worked for two hours, and then left. Do we have to pay overtime?

Please advise.

Yes, you have to pay overtime wages at double the rate if the total working hours in the week have exceeded 48 hours. If the employee had taken a leave (with pay) on any day during the week, that day or days would be counted as day/days worked, and 8 hours per day of leave with pay should be included in the 48 hours to decide entitlement for overtime wages.

However, there is nothing preventing a manager from receiving overtime payment. Moreover, if she has not been given any supervisory or managerial powers, then she can very well claim overtime wages.
