Hi, As per the Gratuity Act, a minimum of 5 years of continuous service is mandatory. However, based on the Madras High Court judgment, after the ruling of the Madras High Court, an employee is deemed to have completed 5 years if they have completed 240 days of service in the 5th year. Some employers are releasing gratuity based on this criterion. There are different interpretations of this judgment. You can apply for gratuity and check with your employer.
