Hi Sir, i am working in a mnc company i joined on dec2021 my probation period end and my extensionn also completed on oct 2022 about 9 months went like this now its may 2023 its been 1.5 years i dint get my confirmation letter till now but i got increment letter my probation period is 30 days if resigned my job and thought its 30 days for notice period ,but HR Saying YOu got Increment which is equilent to confirmation only your notice period is 3 months they are saying.

but in my appointment letter it is mentioned" on or before the completion of the probation period or extension thereof, you will be confirmed in employement of the company in writing ,

now i need to follow 1 month notice period and Inform about this point to HR or need to follow 3 month notice period.

i informed in my new company i will surely in 1 month .

Hi

Confirmation after Probation has to communicated to the employee in writing and if not confirmed extension of Probation to be communicated to the employee. In your case neither you were confirmed nor probation is expended. Under the above circumstances your employment status to be considered as on probationary period only. Accordingly notice period terms has to be one month as per your statement.

Increment paid cannot be correlated with confirmation.

To conclude though you have valid stand for one month notice just negotiate with your employer without constraining the relationship.

I went through your posting.
The notice period for you is one month because you have not confirmed so far by the management. Therefore,your status is still continuing as a probationer and the terms and conditions shall remain same as a probationer. The salary increment doesn't change the status of probationer unless until your management confirmed your services in writing. Further, salary increment is given to match the market price rise or inflammation.
What your HR is telling have no base or ground to support their stand?
Your probation period is one month at the present stage. Don't get entangled with the words of HR, because law and rules say so. In many appointment letter a line is mentioned that " The services stand confirmed on competition of probation period ", in this case there is no need of separate confirmation letter. Hope, this is clarified.
