Hello Everyone,

Can anyone share the rules regarding leaves? What type of leave can we provide to employees in an accounting year, and how many days can we provide?

Currently, the company is only providing a total of 12 leaves per year. Is this legal?

Our company is located in Ahmedabad, Gujarat, and operates as a BPO.

Also, our company operates night shifts. Are there any specific rules we need to keep in mind regarding this?

Hi, Being a BPO you need to follow leave rules of Shops and Establishment Act of your State.

Lakshmi Narayanan, sir, thank you for your answer, but I am a little bit confused about Earned Leave. Do we provide them from the start or after they complete the specified period?

As per the Gujarat Shops and Establishment Act, the following leaves are given:

Annual / Privileged / Earned Leave (AL/PL/EL):
- 21 days for every 240 days worked
- 5 days for every 60 days worked

Casual Leave (CL): 7 days

Sick Leave (SL): 7 days

Maximum AL/PL that can be carried forward: 63 Days

Earned leave means leave earned by working for a certain number of days in the previous year. Therefore, EL will be credited only after 12 months of work. In order to regularize the leave patterns, this process will be carried out every January by considering the number of days worked in the previous year (January to December). For employees who join during the year, earned leave will be credited pro rata.
