For entitlement to maternity benefits and any other benefits under any labor enactment, probation is not an issue. Eligibility for maternity benefits hinges on having worked for 80 days within the 12 months immediately preceding the date of delivery or expected delivery. Despite being under probation, since you have been in service for the last 3 years, you are entitled to 26 weeks of leave.
