hello, i am working in a pvt ltd company i just want to ask
is there any legal action can be taken against company that they take work from their employers more than 8 hours my office time should be 10AM to 6PM but no one can never leave office before 9 pm ,10 hours are minimum working hours here and they do not pay for overtime that ,even it is a firm where 60 worker are doing job and min working hours are 10 and max goes upto 15-20 and they do not pay for that pls help me in this case i am sick of it not only me all of the employer who working in that company please help me what i can do for this please tell me where i can complaint against this.They tell us you are in training but in this company atleast 8 months work done. In this company only 6 months training have.
So please help us.

Every company is bound to follow certain rules regarding engagement of employees. Accordingly, no employer shall allow the employees to work for more than 8 hours / 9 hours (if working for 5 days in a week) a day. If the number of hours per week exceeds 48 hours, the employees are entitled to be paid overtime wages at double the rate of wages.

But this is the situation with all companies where the workers are not united and their collective bargaining is absent. That does not mean that you should form a union and then bargain collectively but you can do it directly without forming a Union. You can resist to do overtime or demand extra payment for the work done over and above the scheduled time.

From the description given, it appears you are working in an office establishment and the Shops & Establishment Act applies. The endless working without any compensation for it is definitely against the law, the Labour Inspector is one authority who can effectively intervene in the matter, also the labour unions/trade unions can help in protecting your rights.
