A startup FMCG company which does not manufacture any food or refreshments but do sell tea / coffee. Please let me know under which act should they need to register.

Basically it is a trading concern in FMCG products. So you need basic registration as per the State Shop & Establishment Act. The other compliances like PF, ESI, Payment of Bonus/gratuity / Minimum Wages etc would depend on the number of workmen employed.
