Good Morning All.

can any one suggest me on the following case.

one of our employee expired while in service aged 54 years, should we calculate his gratuity till the closure of his service (retirement) or till the date of death.

It will be really helpful if any one can guide me in this matter.

The legal requirement is to pay gratuity calculating the period of service till the date of death. If you pay up to the date of retirement, the extra amount paid thereof will be a voluntary benefit extended by you.

Hi,

Gratuity payment to be calculated till the date of death only.

For Companies having tie up with LIC under Group Gratuity scheme, if they have opted for a special rider option then LIC will pay Gratuity till the retirement date of the deceased.
