Can notice period served for a month be considered for gratuity payments? Eg 4 years 11 months regular service and serve 1- month notice period totally 5 years?

Hi, Yes you are eligible for Gratuity. Total service period includes notice period as well.

If your is 5 days working then gratuity applicability will be 4yrs 190 days, if the company is working 6 days then 4yrs 240 days as per the Gratuity Act. Hence you are eligible for gratuity whether you serve notice or not.
