A friend of mine joined Org 1 in 2016 where they wrongly marked her as EPS member.
PF was transferred from Org 1 -> Org 2 (where she was a non-EPS member) .
During PF transfer from Org 2 -> Org 3 it was rejected asking for clarification if she is a EPS member or not.
She approached the PF office for Org2 and gave a declaration that she is ready to forego the EPS contribution from Org1 and was able to transfer PF from Org2 -> Org3 ( non-EPS member).
Meanwhile, she approached Org1 and got a clarification and updated form-3A submitted to Org1 EPFO to convert her from EPS to non-EPS member.
But they refused the same stating:
1. Since service has been transferred out then only the active service can take a decision on this.
2. She had withdrawn two old PF accounts where they had added her as an EPS member, so the PF office says to collect Scheme certificate from those and submit and get Org2 EPFO to add EPS contribution.
In her service history , it shows as below:
Org 1 -> DOJ / DOE for both EPF and EPS present.
Org 2 -> DOJ/DOE for EPF present but EPS DOJ/DOE are marked as "NOT AVAILABLE"
Org3 ( active service) -> DOJ for both EPF and EPS is present.
Please note that her salary has always been greater in all 3 Organizations.
Now , PF office for Org 3 says that they will remove the EPS DOJ and mark it as "NOT AVAILABLE" since she is a NON-EPS member.
However the Org 1 still has DOJ/DOE for EPS along with some contribution.
Please guide what impact will this have :
1. On PF transfer to next organization in case she changes job
2. On her PF advance claim and PF account closure post retirement. (PF office says that Form-19 for EPF has nothing to do with Form-10C for pension and they cannot remove EPS dates from Org1 )
