I am a Central Government Confirmed Employee. I have been issued a charge sheet. The charge leveled against me in the charge sheet is that I have written two different names of the institute for passing B.A. and M.A. Hence, it is misleading and false information and a violation of CCA (Conduct) Rules.
The inquiry Officer submitted a report, and it's mentioned that the charge leveled against me in the charge sheet is NOT proven. However, the disciplinary authority overruled the inquiry reports and gave his findings for disagreement with the inquiry reports, resulting in the penalty of "Removal from Service."
While giving the order of Removal from Service, the Disciplinary Authority stated that the said institute is not recognized by the UGC. My question is: How did the Disciplinary Authority bring in a charge outside the purview of the charge sheet? Because the institution not being recognized by UGC is NOT the charge leveled against me in the charge sheet. My charge is that I have written two different names of the institute for passing the BA and MA. Keep all your documents—charge sheet, inquiry proceedings, exhibits produced during the process of the inquiry, the inquiry officer's findings, termination letter from the disciplinary authority, your academic certificates, your service rules, etc.—handy and meet with an advocate who specializes in labor laws for necessary actions.
As you are a Central Government employee, you have a lot of protection—utilize those.
If the inquiry officer's finding is "Not Guilty," then termination by the disciplinary authority, in my opinion, is illegal.
