I don’t know the Pakistani law on this But in most countries (including India), such an agreement would be invalid and unenforceable. You better check with a local lawyer

Dear Farhan,
You may include a condition in the appointment letter( which basically is a contract) that "The employee is not permitted to take up any job of any nature with any agency/concern , for financial gains or gratis , till he is on rolls of the company"

Oh, you mean he was working for a competitor while still being employed by you?
I thought it was after he left.

Please ensure that you put the point and the background clearly or you will get a wrong answer like you just got from me.

I am not familiar with Pakistani Labour laws, but I am sure that even without having a specific contract, employees are not allowed to work for another company without approval of the main company. You will have to check the laws though.

Otherwise, Col. Rathi's suggestion is right

Confirm with Pakistan labour law , if there are not applicable double employment law ,Then you can take action Regards Ram
