We have administrative office registered under Shops & Establishment Act. We have Construction Project Offices at various places. We have Registration under Contract Labour (R&A) Act for the Construction workers working the Project. Now, please explain, under which act the Engineers and Clerical Staff working at the Project Offices shall be covered.

Dear Colleague,
There are 3 major Acts applicable for your type of Organization.

1. Your Registered OR Administrative Office to be as rightly mentioned registered under the Shops and Establishments Act in the respective State.

2. The site offices in various locations if located outside the Project Sites are also to be registered under Shops and Establishments Act in the respective State.

3. As far as Project Sites are concerned, the workers are to be covered and registered under Building and other Construction Workers Act as it will apply and the CESS payment to be ensured as the Actwill apply for the working personnel. In addition to this, The Contract Labour ( R&A) Act and The Interstate Migrant Labour Act (if you engage workers from other states in the site) will apply ( like for example if the construction is for Factory as and when manufacturing is initiated, then The Factories Act 1948 will apply and so on and the Principal Employer has to ensure such compliance)

4. Now, your Engineers and Clerical Staff as they are part of Project Offices they will be governed by the Shops and Establishment Act. Once the Site work is completed, then based on nature of the operations carried out in the Premises appropriate legal provisions will apply.

5. For all your Administrative Office, Project Office you need to cover them in Provident Fund Act and ESI Act. In case of Project sites they have to be covered under Provident Fund Act and Employees' Compensation Act and so on in addition to what is discussed above.
