Hi, I have joined the organization on 8th Nov’2021. By when can I avail myself of paid 6 months of maternity leaves. What will be the terms and conditions for the same? Please explain in detail. Thanks

The eligibility for maternity leave comes if you have been working as an employee in the organization for at least 80 days in the past 12 months.

As I have joined on 8th Nov’2021 and I get pregnant in April’2022 and I have completed 80 days working condition. So am I eligible for the paid maternity leave or do I need to work for 12 months before getting pregnant?Is it mandatory to work for 12 months or 80 working days are enough?Please explain.

"The employee is eligible for maternity leave if she as worked for her employer at least 80 days in the 12 months immediately preceding the date of her expected delivery"

If you are working from November 21 to April 22, you have already covered the expected criteria, so you are eligible for availing Maternity benefits.

To get a Maternity benefit for any female employee one has to complete 80 days in the organization. She will be eligible for 6 months of Maternity leaves as per the new amendment. The organization shall pay full salary for these 6 months if an employees is not covered under ESI. If the employee is under ESI , she will get all the benefit from ESI and in that case company need not pay maternity benefit.

In India, female employees who complete 80 days in an organization during the 12-months time period before the expected date are only considered eligible for maternity leaves.

In that case, you will be eligible for maternity leaves only after the month of April 2022.

At the same time, it is important to note that different companies follow different leave policy. Taking the same into consideration, you should check with your HR department and understand the policies followed by your organization. They will definitely help you better and clear all your doubts regarding maternity leaves.
