Dear Colleague,
In the absence of any documents like Offer Letter, Appointment Order, Contract of employment singed by both sides or Code of Conduct or Service Rules signed by both sides, or if no any Standing Order for the establishment and a clause on notice period is stipulated, then service notice period is not mandatory or there is no legal obligation on the part of employee. Hence please check for the presence or absence of these documents and ensure before you decide further in line with the outcome

I have different take on this issue. For instance, Delhi Shop and Est Act states that a person who has worked for 3 months must be given one month notice.
Salary by cheque , can establish the fact that a person was employed, hence , if the case pertains to Delhi, one month notice can be considered mandatory for both parties.
Suggest check state specific Act.
