Hello Everyone, Please suggest about Maternity Benefit Act-1961. We have female staff employee in various department. Some female employee has covered in ESIC and some employee not covered in ESIC. Now the question is, we got information that two female employees were pregnant. Unfortunately, both employees faced the situation of miscarriage.

Please suggest us about their leave and wages liability of employer as per law. Are uncovered ESIC employees eligible for leave and wages from the company?

Dear Naveen,

When an employee stands out of the coverage of the ESI Act for whatever reason, she is entitled to maternity benefit under the Maternity Benefit Act, 1961 for child birth, miscarriage, medical termination of pregnancy. I request you to go through the Maternity Benefit Act,1961 for further details and revert back in case of any doubts.
