Pf claim by parents of deceased son - wife left him without giving divorce
Hi one of my friend met with an accident last year and he was under coma. he was married just a few months before the accident. while he was bedridden his wife left him giving letter under police evidence that she is leaving him and will not claim any from him property employment dues etc. no divorce has been obtained under court of law. after some time he passed away. now when his aged parents submitted claim for their deceased son s provident fund dues the same has been returned stating that since he is married his wife can only claim. now the whereabouts of his wife is not known. in the form 2 for nomination there is no mention about his wife. the nomination has been made in favour of his parents and his brother. please suggest how to claim the provident fund dues by his parents. regards erv

I am a member of the employees provident fund and have been voluntarily contributing 100 of my basic salary rs.6500/ per month for the last several years. i am not married and do not intend to get married or raise a family. i have the following members in my family: amy 82year old mother bone married brother ctwo married sisters i have just come across 2 clauses in the epf scheme : 1\"if a member has a family at the time of making a nomination the nomination shall be in favour of one or more persons belonging to his family. any nomination made by such member in favour of a person not belonging to his family shall be invalid.\" 2\"a family means i in the case of a male member his wife his children whether married or unmarried his dependant parents and his deceased sons widow and children.\" i have nominated my 82year old mother. however she has her own sources of income like bank interest rental income etc. and files her own income tax ret

Dear all i had come across the situation where i required your help. in my company there is an employee who had made nominee his mother long year back. but when time passes he got married and not change his nominee. but today he come to us and asking to change his nominee in pf. as per my knowledge if a person get married his nomination is cancelled automatically and he has to apply for fresh nomination. plz suggest me whether we have to give all those forms again to that employee for fresh nomination or it will automatically take place. our employee also come to the situation that his father had not made any nominee in his pf. now by his sudden demises every body is claiming for money. in this case what to do. plz suggest us what the precationary measures we have to taken if a employee get married. would appreciate for your early responses. regards ranjeet
Importance of nominee in pf/esi/gratuity forms
Dear members as an hr we are responsible for getting the nomination form for ratuity correctly from the employees and also fresh nomination has to be got from the employees who gets married / divorced/ nominee dies. mostly the same has not been given in the company policy / procedures but as an hr the above has to be educated to the employees. the importance is known only when the employee dies and the nomination is not given correctly / updated. as per law for an unmarried employee the dependent parents would be mostly nominee and after marriage the nominee changes as wife/husband even if they dont update the nomination form because they become the legal heirs. there are some instance where after the employee death the wife/ husband has got the money and the dependent parents are left alone and vice versa. even though it is done on some occasion the blame has to be taken by the hr only. if the employee is properly educated on the importance of nominee then he would have given as 50:50 75:25 60:40 100:0 or the case may be. request all the hr members to educate the employees the importance of nomination / nominee in the statutory forms. also kindly share your experience you had faced of nomination in in case of death employee. the motive here is all the dependents of the deceased employee should be benefited without any grievances
Gratuity
Dear all one of our employee passed away and we are not payable gratuity amount to him. we have not collected nomination form from him and now his wife and his parents are claiming the gratuity amount. in that case who will get the gratuity amount. it is understood from the parents that the deceased wife got married. in that case is she liable to get gratuity amount. regards hema
