Dear Sir, My name is Hitesh and I was working with a Mumbai-based company till 31-Aug-2021 and I joined this organization on 16-June-2021. This organization was not ready to relieve me when I resigned on 19-Aug-2021 and I was ready to buy out my notice period as well for the remaining period and they started harassing me. Now I have joined a new organization in Gurgaon on 01-Sep-2021 but my previous organization is saying they will mark my all exit formalities on 15-Sep-2021. Now I am worried that it has become a case of dual employment.

I would like to know how it will impact my new job and whether my new employer would be able to open epf account and share their contribution for the same as their will be an overlapping period. Can I lose my present job for this issue? Please advise.

The new company where you join can register you from 1st September. Since the Universal Account Number remains the same, there is no issue. But you may face difficulties in transferring the balance and service from the old company to new company. In order to avoid difficulties in future you should initiate to mark exit from the previous company by visiting your member portal at the earliest. If you mark your exit from the previous company on 31st August, the maximum the company can do is not to approve it. For that you can file a complaint before the appropriate authority of the EPFO and they will help you to get it approved. If, on the other hand, the previous employer has already put date of exit as 15th Sept, then also you can file a complaint and get the same corrected. Since your present company is contributing to PF from 1st Sept the date your previous company has put will be construed as wrong date.
