Please clarify

1.Who is the principal employer if there is a contract with the agency and agency deputes its staff for working onsite in any organization.

2.What are the liabilities of the organization on whose premises the workers/contracts labours are working?

3. In terms of salary, is any pf deductions etc need to be made?

4.Is registration mandatory for contract labour by the organization where staff/labours are working on-site, even if the contact is with the agency?

This query is in regard to Bank.

1. Principal Employer in the perspective of the 'contract' with the agency is the organization where employees are deployed.

2. All liabilities of a Principal Employer

3. Yes, the Contractor shall comply with it. Principal Employer shall make sure that the Contractor fulfills compliance formalities

4. To employ contract labour, it is mandatory to register the establishment. Principal employer shall submit an application in the given format.

Please advise, if the contract employee are less than 20 then also the registration is required.?

and is the registration needs to be done by each office/branch premises individually or a regional office shall do it on behalf of each branch/office.

Dear Member, If I have understood correctly the arrangements in the present case :
your Bank has engaged the agency for rendering services to your clients locations though a contract. In this case Bank is a Principal Employer( P.E) and the agency is Contractor. The deployment in the premise or outside is not material in the case.
All the liabilities and responsibilities will be discharged by the agency as Contractor and by the Bank as Principal Employer.
Social security( EPF & ESI) compliance will be ensured by PE of course may be through the agency/Contractor. Yes, Bank registration is must if that contract labor in this contract stand alone or put together with other contracts of labour supply with Bank exceed 20 nos.
