Hi,

There was an employee in our firm. She was performing poor but since her probation had passed and she was a fresher, in order to not ruin her career, we told her that e were laying her off due to covid so that her paper work looks good n she can find another job. We paid her two month notice period without asking her to work since she has been constantly rude with us and we feared that she may damage our software so we paid her notice period n told her to stop working just take money n find another job, she also denied returning company laptop giving covid lockdown excuse but during that time she took leaves to visit her native place. At the time of hiring she got laptop from office so it was her duty to send back. We even reimbursed her laptop courier charges. In such a case, I do not have good things to say about her at all in experience letter and relieving letter. Is it mandatory for me to provide her experience and relieving letter? If yes, can I write the following in relieving letter:

"This letter is to confirm your dismissal from the company effective immediately.
You have been provided with the severance pay for the two-month notice period.
We thank you for your association with us during your tenure from 17th Feb
2020, till 13th July 2021 as a Junior Software Developer.
Please remember that you have signed the confidentiality agreement and non-compete agreement with the company and shall continue to be bound by both the
said agreements even after the termination of your employment.
We wish you success in all your future endeavours."

and this in experience letter:

"This letter is to confirm your association with us during your tenure from 17th Feb 2020, till 14th July 2021 as a Junior Software Developer following your termination."

Instead of giving termination letter, it is better to get resignation letter from her and relive her from the service. Can give service certificate and all legal dues ( full and final settlement)

You may issue these letters, she would obviously react, ask her to return all your items, then you can issue her a suitably modified letter.
