Joining a new psu after resigning previous psu but without informing both new psu and previous psu and without noc
Dear sir i am in probation period of 1 year in a psu 'x' and i have executed a non judicial bond with psu 'x' to serve it for five years after probation. now after 8 months of joining psu 'x' i have got an offer of appointment from a new psu 'y'. what i am intending to do is resigning the previous psu 'x' before joining new psu 'y'. but neither i have informed about my previous employment to new psu 'y' not about my new job to the psu 'x'.can this action of mine lead to any legal action?? if yes then what will be an appropriate solution as i am very keen to join new psu 'y'??? also i have to join new psu withing 15 days.. please reply as soon as possiible thank you
Vrs joining another psu
An employee took vrs voluntary retirment from a psu in 2002. he worked in private for 5 years. he saw an advertisement from a psu in which there was no bar on vrs optees. he applied mentioning vrs in resume etc and got selected and joined another psu in in 2007. the first psu came to know about it and demanded refund of exgratia as per the application form he signed for vrs in 2002 in which it was preprinted "i will not be allowed to join govt/psu and if i do i will have to refund the exgratia received". now the questions are 1.whether such a condition from a psu is valid in view of section 27 of contract act restraint of trade is not valid? 2.whether the refund can be claimed as per contract act section 73 no loss suffered by first psu due to breach of contract? 3.whether refund can be enforced by the second psu? 4.whether disciplinary action can be initiated against the employee by the second psu? there is no rule available to charge. the rule is clear "dishonesty against the company" is misconduct
Gratuity
I am working in a psu. i was initially appointed in november 1984 on contract basis for one year then got extended on expiry of each term without giving any break . this continued till august 1990 where i was absorbed in the regular cadre of the psu before the expiry of my contract the contract was to expire on august 1990 but i was regularized on 1st august 1990 . now i am about to retire and p&a of this psu says that i will not get gratuity for my contract period ie from november 1984 to august 1990 although i have been in continuous service with this psu for more than 5 years without any break. the p&a of this psu say that as per the gratuity scheme/rule this psu contract employees are not eligible for gratuity. moreover gratuity is not mentioned in the original contract appointment letter. kindly let me know whether a psu can have its own gratuity rule. is it mandatory for a psu to follow the gratuity act 1972 and its subsequent amendments. i was serving as a contract employee not as an apprentice and for this reason the p&a of this psu should count my gratuity from my initial contractual employment. kindly let me know your valuable advice and suggestions. thank you

Service continuation in application through proper channel
Dear seniors i am working in a psu for more than 5 years. i have applied in other psu through proper channel by forwarded application and got selected. as a mistake i have tendered my resignation mentioning as suggested by my hod. after realizing my mistake i have submiteed another letter mentioning the intention of joining the psu where the application was forwarded. queries 1 seeking the above scenario will my resignation be treated a 2 will i get the service continuation in new psu? what are the benefits of service continuation? 3 as per my knowledge after relieving my present psu will start settlement process including leave encashment and gratuity? should i accept the leave encashment and gratuity? 4 where should i approach present psu or new psu if i wish for leave and gratuity transfer. thanks and regards bablu

Hello i need a help for your your suggestion or comments for the following grievance: i had worked in a psu at a permanent roll of the company but the company psu is closed by the government and all the employees are given vrs and separated from the company now its being completing a year and i cleared a interview in another psu on fixed tenure period 2 years at regular pay scale. now the psu where i am selected demand to surrender the vrs amount due to guidelines issue that states " once an employye opt vrs and again he gets employement in another psu he has to surrender the vrs amount before joining " but the question is that my employment is under fixed tenure basis to another psu so refund of vrs compensation is applicable?
