Hi, I have recently joined a company a month back (in that 1 month I took leave for a week). I have now resigned from the company due to family commitments. Do I need to serve a notice period for 3 months? I am ready to pay the buy-out amount to get an early release. But if the company doesn't agree to buy out what should I do?

After formally getting employed in an organization, one has to strictly abide by the rules and regulations of employment in force in the organization and the personal inconveniences of any individual employee does not matter. The employer can refuse to accept the buy out option of notice period by the exiting employee in full or part on the ground of work exigencies.

Usually in most of the service conditions ( appointment letter ) it is mentioned at termination clause that either party may terminate( by the employer ) or resign from the job after serving the notice period or pay in lieu of the same. It is applicable both for employer and employee. As no one is bonded labour as on date, the employee may not serve the notice period instead pay the notice period amount.

Apart from what seniors has already adviced, as you mentioned you recently joined so in such cases you must be in probation period, please check the employment terms i.e. termination clause during probation period
