The employer can refuse to accept the buy out option of notice period by the exiting employee in full or part on the ground of work exigencies.

nanu1953Usually in most of the service conditions ( appointment letter ) it is mentioned at termination clause that either party may terminate( by the employer ) or resign from the job after serving the notice period or pay in lieu of the same. It is applicable both for employer and employee. As no one is bonded labour as on date, the employee may not serve the notice period instead pay the notice period amount.
