Dear All,
A quick help needed.
I don't have Form 16 but the Bank Statement.
I got placed in HCL. Third party on behalf of HCL asked me to submit Form 16 in order to complete background screening.
Instead I provide them Bank Statement of last six month as requested by them in place of form 16.
Is not having Form 16 going to be the reason for failed background verification.
Please suggest asap. I already put down my papers and date of relieving reaching near.

if TDS was deducted from your salary in proceeding year(s), then form 16 was supposed to be issue, instead you can get the similar document from income tax e filing site as 26AS (Tax credit statement)

1) Do you mean not having form 16 would be a problem if TDS was deducted. or 2) Not Having form 16 would be a problem if TDS was not deducted.
What if they kept the tax money in their pocket but deducted it from the employees' salary? basically, they deducted a portion from the salary saying it is for TDS but they never actually processed it. They didn't open a Pf account but I believe they kept the deducted portion with them only. That's why i don't have form 16.
Please suggest.

PF and TDS both are different things, PF is deposited in EPF but TDS is income tax

Please register with https://www.incometaxindiaefiling.gov.in/home,if not done earlier.
You can view your form 26 AS and know whether TDS deducted is shown in form 26 AS.
As far as PF is concerned ,check with your PF account and see credits.Deduction of PF and nod deposit in EPFO is a serious offence and company will get prosecuted for it.
Just do basic cross checking and find out.

I checked, there is no tax entry for the tenure I worked with my previous company. However, the previous company was consistently deducting the tax from the salary. I and We all employees were under the impression that our tax was processed by the company but later we find out it was not done by the employer due to the lack of awareness of Indian company law as the employer was a resident of the USA.

I don't see this as my mistake but the employer's mistake. Do you think it is going to create a serious problem in the background verification?

Note: The verification agency had asked me to submit a Bank Statement, form 16, and Statement of fact. I have successfully provided the Bank Statement and a genuine reason why I don't have form 16. Do you see any chance here that the agency is going to use that Bank Statement to flag my bg status as red?

Your bank statement will provide proof of salary drawn and received by you.
What about Income tax?
Have you not filed IT returns?
Deduction of IT and non deposit is an offence.
How long did you work with that company?
Any way bank statement will be helpful in proving your salary receipts.
I really dont think that BG Verification will go against you if you show other details of employment-like employee number,profile,appointment and exit letter etc

Yes, Bank Statement is clean and can provide salary logs.

The company which deducted TDS and didnt deposit can face action from IT department.
Are you submitting/filing IT returns?

Yes,
I haven't Filed For any IT returns For the duration I worked with that company. Neither Filed tax as I was under the impression that it was deducting From my salary.
Is it going to make any diFFerence now in bg verFication?
