Dear All, My query is w.r. to Minimum Wages. I based at Hyderabad and working for a company manufactures wood laminates.
1. Under which schedule we fall under to pay the Minimum Wages??
2. Minimum Wages has to be paid for 26 days or Month days??
3. If it is for 26, in a month if working days or 27 or 23 how the calculation has to be made??
i request the fraternity please give your reply with document proof if any???

A. In case you are a factory registered as per the Factories Act 1948, you would be covered in item no. 1 i.e.,

1. Any Manufacturing Process carried out in Any Factory as defined to Section 2(m) or Section 85 of the Factories Act other than those notified under Part-I or Part-II of the Schedule of Minimum Wages Act, 1948.

If you are not a factory then probably item no. 60 i.e., Wood Working Establishment including Furniture excluding Timbering Operation

would apply

B & C. The notification has both monthly as well as daily Minimum wages. So if the employee has worked on all the days pay notified wages for the whole month. If there is any deduction to be made it has to be on the basis of notified daily wage. The standard month comprises 26 working days and daily wage is computed by dividing monthly wage with 26.

The notification itself is the proof of it.

Miniwgaes notification issued by relevant authority is the base reference for deciding the wages as per the scheduled employments list given in the notification.
Type of business that falls under the scheduled employment category is to be chosen for applying minimum wages.
If the business is not listed in scheduled list, you may apply minmum wages under factories act if it is a factory or if it is not factory then Shop and estd can be applied.

Regarding the category under which a firm comes is confusing to me. Can you guide me to how to understand regarding which category a company falls in. As you said if it is a factory, then any Manufacturing Process carried out category should be chosen. But, the other options also look like manufacturing categories, for example - Slate Factories, Steel Mills, Powerloom Industry, Metal & General Engg, Jute Industry, etc. now all are manufacturing companies. SO which category to decide for fixing a companies minimum wage?

My previous factory follows Monthly wage system but gives salary on this basis = (Wage*present days)/total working days in that month. Example if 2 days absent for Feb, then Salary = (Wage*22)/24.
Salary is deducted after giving 8 national leaves + 15 EL. No other leaves provided like CL, SL. Is the wage structure and leave policy right? Factory says, no other leaves according to factory act.

Dear Madam,

government notified 65 schedules under which most of the companies fall under. If a company does not fall under 64 categories then if it is a factory then it will fall under schedule 1 that is any manufacture process... if a company is manufacturing engineering products then it will fall under general engineering and metal foundries schedule category.. if a company is manufacturing jute products then it will fall under category. government notified the minimum wages for 65 schedules and it will be revised every six month.. you have to follow the same..

wage calculation of minimum wages as per law is 26 days only. if working days is 24 or 27 you have to calculate the MW with 26 and pay.

one EL per 20 days you have to pay....

correct me if am wrong and suggest....

1. Under which schedule we fall under to pay the Minimum Wages??
2. Minimum Wages has to be paid for 26 days or Month days??
3. and also how to calculate monthly pay incl ESI,PF,1/6 of relieving charges,4 % service charges.
Iam request the breakup payment please give your reply with document proof if any???
