hi friends!!
please suggest me for the following case.
suppose a garment retail shop like pantaloons, big bazar etc opened a branch for retail business at New Delhi. To start the activities at New Delhi it transfered some employees from other state. Then it employ some fresh employees at New Delhi as TRAINEES. After completion of 6 months of training, some of the trainers were terminated on the ground of unsatisfactory performance.
What step would you take during the entire process so that your company (retailer of apperal) is protected under various laws?[/b]

Dear
Safely follow the process under the Industrial Disputes Act for retrenchment. You will have to give them notice or Notice pay for one month. If you perceieve a legal problem take specialist advice.

Though under ID Act, work of 240 days in the previous year is required to refer such employees as employees. Therefore, termination of trainees after 6 months of service will not attract any complicated labour dispute. However, to be of safer side, at the time of employing itself, an agreement to the effect has to be made that: "if your performance is found unsatisfactory, your service will be terminated without any notice". As there is every chance of such incidents getting inflated by those who vehemently resist coming up of RETAIL GIANTS, care should be taken in dealing with such situation. Alternatively and being an organisation having network all over India, those whose performance has been found unsatisfactory shall be TRANSFERRED to a remote location, following which the trainee(Employee) will be constrained to leave submitting his resignation.
