Hi, I am HR with 4 Years of experience. worked for 2+ Years for a startup and helped to reach headcount from 15 to 50 in 1.5 Years with so many challenges. Recently on 4th September 2020, I was on emergency leave due to the ill-health of my grandparents at the same time, the Head of Indian Operations was terminated for no reason and I was pressured to work in emergency conditions on Sunday. I dropped a mail about my situation even to the CEO and told them I am on emergency leave.

Thought to help them on Monday i.e., on 7th September 2020, my login credentials are not working. Felt bad and I don't have a way to communicate with anyone in that company. I collected the email of the CEO and asked him for reason. He said security issues so changed mail credentials and asked me are you still interested to work with us. I was in shock and I don't know what's happening.

They terminated me on 5th September 2020 on Sunday for no reason and after 8 days, they sent termination mail to recover company assets.

I questioned them about the reason for termination. No reply and I demanded 2 months' compensation for improper termination.

They asked to serve a notice period and take compensation. Again I was shocked.

How an employer can terminate an employee who worked for 2+ Years without any reason and after sending proper termination, how can an employee serve a notice period?

Even for that I was ready and asked for job security for 2 months but no reply from them waited almost 15 days

Now, they are demanding me to pay 2 months salary to them and submit the laptop. I was ready to submit the laptop and asked to send people to collect.- No reply.

What can we do such as CEO and COO?

The Company is in Gachibowli, Hyderabad

CEO - In the US

COO - In Bangalore

Don't know, who are HR and no point of contact. No one responds to my email.

I reached Corporate Lawyer, but they are asking 20K to send the notice.

Any suggestions on how can I deal with such people. Because they are holding my experience certificate and blackmailing.

The employer terminating service and at the same time asking for notice pay is clearly untenable in the eyes of law. You have already indicated your intention to return the laptop, is there any other item with you, if so offer to return all of them. So also you need to ask them to pay your dues, as per your calculation, include notice pay, unpaid salary, leave salary, bonus/incentive and any other financial benefit you are entitled. Mark copy thereof to the Labour Inspector of Gatchiboli as well as the Labour Commissioner of Telangana. Like they have threaten, you also have to threaten to expose them in media, NASSCOM, local Industry Association etc.

in place of corporate lawyer, you have to approach a labor lawyer, or just a civil lawyer nearby to send a notice, then proceed to labor commissioner of the place of establishment jurisdiction(in India)
Don't get in hurry to fight with overseas employer, but move for redressal from establishment in India only, Labor commissioner and labor court will handle the next part with suitable measures, and if needed they will inform the MEA to look into the matter.
