Dear All, We provide laborers on a contract basis, and all those employees' EPF and ESIC are filed regularly. However, we have another business in event management for which we pay other agencies to provide emcees (manpower); usually, they don't have EPF and ESIC. Can someone explain what our liability will be?

In the scenario described, where you engage emcees (manpower) from other agencies for event management on a contract basis for 1 or 2 days, the liability for EPF (Employees' Provident Fund) and ESIC (Employees' State Insurance Corporation) would depend on the specific circumstances and legal requirements in India.

EPF Liability:
- EPF is applicable to employees earning below a certain threshold, which is subject to change as per the regulations. If the emcees you engage for event management work fall under the EPF threshold, you may not be required to contribute to their EPF.
- However, if the emcees' earnings exceed the EPF threshold, you may need to consider including them in the EPF scheme as per the law.

ESIC Liability:
- ESIC is applicable to employees earning below a specified wage limit. If the emcees' earnings are above this limit, ESIC may not be mandatory.
- It is essential to verify the current wage limit and compliance requirements to determine if ESIC contributions are necessary for the emcees engaged for event management.

Practical Steps:
1. Review the current EPF and ESIC thresholds and regulations applicable in Mumbai, India.
2. Assess the earnings of the emcees provided by the agencies for event management to determine if they fall under the EPF and ESIC coverage.
3. Consult with a legal advisor or HR expert well-versed in Indian labor laws to ensure compliance with EPF and ESIC regulations.
4. Maintain accurate records of payments made to the emcees and any relevant documentation related to EPF and ESIC compliance.

By following these steps and staying informed about the legal requirements, you can effectively manage your liability concerning EPF and ESIC for short-term contract work in event management.
