Hi Team,

Is it right of my employer to recover from my FnF the leaves that I have not applied on the attendance portal during my working tenure.

My argument is that,

- my manager had always approved the attendance without verifying the attendance data given to him by the client on monthly basis.

- I see this as my fault as well as process failure i.e failure from my manager to verify and approving the correct attendance every month.

- I believe that the employer should also accept their part of failure and not try to recover only from the employee.

Now for audit purpose, company is saying they will deduct the total leaves that i have taken from the available leave balance on the attendance portal.

In my opinion, if they want to deduct, they should consider my total entitled leaves every year i get and not base their calculation on the available leaves from the attendance portal.

Please suggest if the employer is correct or is this unjust.

Richardson - LMS differs from organization to organization. The total balance leaves in HR system on LWD is frozen and encashed to the employee at the time of FNF preparation.
Practical advice:
1. Did you retain a screenshot/ document explaining the leave balance - If yes, please support your explanation and ask for a logical explanation of adjusting/ encashing of leaves in your FNF. Also, please arrange the exit policies and read through the FNF clauses - also will give you an important perspective.
2. I see this is a systemic failure - where attandance/ leave records are being handled frivolously - with both parties failing to exercise strict control over its mainetenance. Not to elongate the matter - please comply with HR's decision - as you are bound by policies and changes therein - you will not have any base to contest your reasons.
All of the bonafide employees reading this answer should realize the importance of following processes - despite their meagre importance in our everyday work. Such things always crop up at an important time like this and may cause a failure to other processes as well - also known as the 'trickle-down' effect.
3. Do not stretch the matter too far - as this will impact you and your relieving from the organization only. Please settle the payment/ recovery - as the case may be - and have peace of mind - which is very important in these times.
