Dear Seniors,
One of my friend who is Software Engineer by profession resigned from his current company. But his superior( project manager) is not accepting his resignation. It has been 10 days and then too he has not accepted the resignation. He cannot give his full notice period that is one month as the other company is asking to join asap.
HE doesnot want to miss the opportunity but his superior is not ready for accepting resignation. He has tried his level best to convince the boss but he is not ready.
Can he join other company without having resignation acceptance mail or letter?In case other company is ready to take him, shall he join?
Will it create any problem in future as he will not get acceptance & relieving letter from company?
Does any employer has this right to do this with employee.
What are the steps employer can take if he joins new company without resignation acceptance

Hi,
Ask your freind to speak with his/her senior once again.Let him understand why they are not accepting?still if he is not able to make his senior accept his resignation,he can always meet the next senior person or meet the HR manager/GM/VP-HR/M.D and handover his resignation letter.
He can also mail his resignation to his senior with notice period.Then he can serve his notice peroid & leave the company.

As my opinion u should give one month notice otherwise u have to pay for one month salary against notice period. Incase u didnt give one month notice and didnt pay the amount and u leaving without completing the relieving formalities, in your present employer will do any verification about you your past employer wont response this.

This is a difficult but common problem these days .My suggestion would be to ahve a word with the project manager and try to understand the reason for such denial to release him.Ask him to document every communication with managment and HR that he is having in his current organisation
The most important thing is he should have a word with the HR of the prospective employer about the situation and request them to extend the joining date if possible

Hello dear,
There are many things to cosider,
If your friend is in agreement period with his/her employer it would be a problem,
If any certificates are with present employer then it would be another problem to your friend,
If the present employer had issued offer and appointment letter when your friend is joining his company then the employer needs to issue the relieving letter to your friend.
and your friend can demand if he is not in agreement (period) with that company.
Just check out with the notice period also,
The present company in which he is going to join if maintains any policies with regard to joining of new employees then it might be a problem.
These are my views on this case, just check out with others also.

Just join the new co. Asap.
New co. Hr once taken u in, he cannot fire u later for non submittion of releiving letter, just mention this situtaion in your joining letter also. Keep new hr person in confindence.
Rest for present co. Just shoot the mail to all senior mgmt and mark cc to your project head and ur personal email: Stating about resignation and wish to serve notice period as much as possible. ( try to serve full notice period as mentioned in appointment letter or offer cash back and request them to releive you) if they respond good, if not don't worry it will not hamper your carrer in future!

Hi,
Would suggest you speak to your senior once again and make him understand for what reasons you want to switch. Also, understand why is he not ready to accept your resignation. If this does not resolve. Consider speaking to the hr of the other company, they might consider your bank statement instead of salary slips and you can share with them your offer letter and appointment letter for Date of Joining details.
As far as problems are concerned for future, yes you might face issues later, incase you work for a firm which conducts back ground verification, there is a possibility that your reporting manager might share incorrect information.
So, I would suggest you must discuss with him and incase this des not resolve you should talk to the superiors as well.
