Our female employee has 10 earned leaves and 5 sick leaves available which would lapse at the end of the year in dec-2020. She would go on a maternity leave from 15 jun-2020 and wants to take the existing EL+ PL at the end of dec-2020. The company policy says no preexisting leaves would be valid after maternity leave. The employee is arguing that this should no be the case. Is the company policy in line with general practices? If not, is the company still allowed to do so?
