I have newly joined this organisation, where they withhold employees confirmation, in spite of an employee completing more than 2 years in the organisation. The management say we keep on hold so that we can discuss with the employee about their performances.
My question for how long company can keep employee confirmation on hold as per the LAW?
The answer is No.
As per the Law maximum a company can keep an employee on probation is 6 months + 3months of extended probation if employee shows poor performance. After that the company has to either terminate the employee or provide the confirmation letter.

The period of probation depends on the service conditions of the employee. Service conditions are contained in appointment letter for management cadre employees and certified standing orders or model standing orders and other Labour Laws in case of "workman" category employees.
