Notice period buyout - asked to pay gross instead of basic
Kindly guide on notice period. if an employee is not able to serve to employer on notice period due to some or other reason. but ready to pay notice period amount.and asked to pay gross instead of basic. this is the case happened with one of my relative were he have to leave organisation as notice period is for three month & amount asked to pay is three month gross. now my question is : is there any law that specifies an employer can charge gross pay instead of basic pay? what is this statement means mention in letter: have to serve 3 month notice period or in lieu 3 month salary. does this specify three month gross salary. because paying three month gross is very high for any employee. please show some light to understand policy related to notice period. that help my family in may ways. regards yamini b
Company says we have not asked you to leave you were absconded
I would like to know if action could be taken against employer as they had asked me to leave the company without any notice and now when i went there for the notice pay and full and final settlement to hr. i was denied for any payment in lieu for notice period and even for the pay for the days i had worked. even stating to that extent that we have not asked you to leave you were absconded. kindly suggest over the same.
Forced resignation email - as an afterthought after director and management agreed on resignation terms
Respected all recently company asked one of the directors to resign on account lower business volume and economic crises due to covid19 director submitted resignation and asked to release immediately the company accepted the resignation sanctioned immediately & relieved him on the same day. management is very generous and benevolent but due to crises things are beyond the control of the management. during the discussion management agreed to pay three months' notice pay in lieu of notice period with all indirect benefits as per appointment terms and conditions instead of serving the notice period. the company offered him a separation agreement wherein mentioned he should not disclose any confidential information to any outsider since he was leading key profile however he refused to sign but submitted an official resignation. on the same day in the evening afterthought he sent an email stating that the management has forced him to resign and he wished to serve notice period he may also send a legal notice to the company management for the same matter. need expert opinion on this situation. 1. should we release three months' notice pay at stretch or month on month till the time three months are not getting over? 2. should we hold his dues for the time being to analyze the situation? 3. is this the right way to continue the notice period without any assignment/work by seating at home.? please advice.
Employer did not pay salary and pf amount - what to do if the employee has not received any appointment letter?
Dear experts greetings... employee requests for leave on 31st jan 2020 for 10 days from 1st feb 2020 to be with mother for medical emergency. it is approved verbally on 31st jan but director asked to send an email. employee send email for approval on 1st feb but did not mention no of days of leave employer did not give any reply to the mail. from 1st feb employee was available incall and was in touch with team members to give any advice and information related to work. organization paid salary on 10th of feb 2020. all staff got salary except the staff who was in leave. when asked about this the director replied the staff needs to join before getting a salary. after the employee was done with their mother s operation intimated her intention to the director to resume duties from 14th feb 2020 director replied she is not allowed to join now. when the employee reached the office to meet the director for discussing how could she get her salary director responded as we thought you left without resignation hence you are not eligible for salary. employee asked she wants to continue and serve the notice for 1 month the director declined to accept her in work. employee joined on may 2018. as per the offer letter the employee needs to serve a notice of 1 month during the probation period but the employee was not given any appointment letter after completing her probation period. in january 2019 director only intimated verbally that she has been appointed as a permanent employee and she will get a salary hike. if the employee has not received any appointment letter then how the employee s employment will be governed by the clause of the offer letter for serving a notice period of 1 month? what are the legal remedy available to the employee so that the employee get pending salary and pf amount? thanks
Notice period payment - executive director terminated immediately due to illegal work
Dear hr professionals i have signed a contract with a senior employee as executive director in 2016 in his contract our ex hr manager added 2 months notice period if both sides canceling the contract. two weeks ago that executive director terminated immediately due to his illegal work negative campaign against ceo & other top management members to junior employees in the organization. now the executive director appealing for his 2 months notice period salary. please share your costly idea with me can i pay his 2 months notice period salary or not? thanks in advance for your time and ideas.

Hi i had given the notice of 3 months of my intention to leave the organisation to my employer and they accepted the notice and relieved me after 5days of giving the notice letter. now they are asking me for the notice pay. am i liable to pay the notice amount to the company inspite of me giving the notice for the required no. of days and they relieving me at their discretion??? when i asked for the notice period clarification through mail as to why i am not allowed to serve the notice period the hr guys didnt revert back and when took the issue to their superiors the hr person called me up and abused me over the phone. kindly let me know whether im liable to pay the notice amount to my employer or the employer needs to pay me the notice amount or full salary? or should i take a legal action on my employer? pls advice. thanks & regards
