One of my relative in govt employee in govt has a service period of 15 years ( 28/2/2003 to 1/04/2018) of uninterrupted service, later went on unauthorised leave ( 2/04/2018 to 1/04/2019) due to personal reason ,which was considered as break in service and he later joined the service ( 2/4/2019 to 2/5/2019) but submitted resignation due to internal issues after 1 month. Is he eligible for gratuity. And how shall his gratuity be calculated ???
Is he covered under DSCR scheme, which govt.dept, state or central govt. Having already completed 15 yrs of service, continuous, for that period will be eligible. Pl.state exact scheme under which he is covered.
He is not sure what is DSCR scheme ? Could you pls explain . He works for state govt
Sorry, I wrongly spelt it, it's known as DCRG (Death cum Retirement Gratuity scheme) applicable for central govt.employees. You mentioned 'State govt'. which state, NCT Delhi ? If adequate details relevant to the query is provided it will enable us to give our suggestions instead of extracting relevant details like this one after another.
Also you should indicate the dept. in which he was working as well. It's to be ascertained whether opted for govt.'s gratuity rules or other scheme like NPS. If he has worked in a factory or other establishments different scheme will be applicable if not the Payment of Gratuity Act. However extract of the scheme applicable to employees of central govt. is attached for your reference. Ok, sorry he is in Punjab govt in health department and a gazetted office and is covered under NPS program. Furthermore for initial 3 years he was on contract which was regularised from date of contract i.e. 2003 .
Another query is that punjab has not implemented 7th pay commission of is his gratuity eligible for max. 10 lac gratuity or 20 lac as per the new rules
