A proprietorship company has no rules to pay maternity salary - as per maternity act? Please anybody help me out

If this proprietorship company is running a factory it should give maternity benefits. If not factory, it should give maternity benefits,provided the company has 10 or more employees. That means it is not the constitution of the company like sole proprietorship, partnership or company, which decides the applicability of labour laws but it is the number of employees. The same principal applies to bonus, gratuity etc.
