Sir, I am from an educational industry. And I have received a show cause notice (EDLI) to my institution which was claimed in the year 2013. the institution was exempted from EDLI in this year. And employee who joined duty after 58 yrs as scavenger and died in the year 59yrs. Having one year of service in this college. By mistakenly the previous principal claimed this ineligible claim to the EPF office and it was settled. And a cheque of Rs.1.6 lakh handed over to his wife.
Now the issue is the EDLI authorities sent a show cause notice to repay the amount with 18% interest. My question here is we didn't have an account in EDLI but they settled without rejecting this claim, now asking us to repay with interest.
Kindly give you opinion in this regard.

EDLI is part of epf , when ever you submit your monthly challan , 0.50% of basic contribute to EDLI, So you reply to epf department that this claim was from employees and now he is no more, so nobody is eligible for pay.if department need any information about employees only can be given.

As per my knowledge EDLI Claim process is approved through the Employer only, nominees of employee can't claim directly without the knowledge of employer. In 2013 all epf claims are physical claims by that time online claims are not available for PF (Form 19), Pension (Form 10c).
EDLI will be claimed in case of death of the member during the service period. All organizations covered under Employees’ Provident Fund (EPF) and Miscellaneous Provisions Act, 1952 get enrolled for EDLI automatically. All employees who are covered under their organization’s Provident Fund and are actively contributing to their PF account (age group of 18 to 85 years) are eligible for EDLI.
First check whether the employee is covered under the EPF or not, After 58 years of service there is no exemption for EDLI.

The institution had EDLI account under LIC in the year 2013. so, they got exempted under EPF account No 21. But instead LIC it was wrongly claimed under EPF. Without verifying the Account it was by mistakenly sanctioned by the EPF office
