I resigned from the company on 25th October 2019. The company is asking me to serve a one or two-month notice period. However, as I need to join a new company immediately, I am unable to fulfill the notice period. I have conveyed this to my previous employer, but he has not agreed to release me. He has withheld my salary and threatened legal action if I do not serve the notice period. The new company requires a relieving letter from my previous employer before I can join them. Since I have already resigned, I will be left without a job if I do not join the new company.
Please advise on the available options.

Please check your employment order terms with your current employer. You are bound to serve the proper notice period as per your employment terms. You should have informed your new employer about your notice period requirement once they have shortlisted you.
Now, you can talk to your new company's HR about the notice period requirement and also send a request email asking for time to serve notice. This way, it will be perceived positively by them that you are a duty-conscious and responsible person. So, present yourself politely to your new employer.
