Clarification on gratuity payable on being transferred from india to other country
I am seeking views about gratuity payable to employees being transferred from india to other country. as per the gratuity rule in india employees completing 5 or more than 5 years are eligible for gratuity payment i would like to know whether a company is supposed to pay gratuity to the employee being transferred within a group company who has a separate legal entity from india to other country even though he/she has not completed 5 years request you to share your views along with proper supporting like extract of laws/ section/ subsection/ etc. thanks & appreciate your help in advance
Calculation of service tenure for gratuity - working in hongkong roles for 10 years and got transferred to india role
An employee in our company was working in hongkong roles for 10 years and he found a suitable position in india and got transferred to india roles. after a 3 year span if he resigns how do we calculate service eligibility for gratuity. actually as he has worked only 3 years in india he should not receive gratuity. but there is contention from hq that he has served in the company for 13 years hence we have to pay him a gratuity. how do you treat this case? is he eligible for gratuity as per the india gratuity act? also to know he was directly recruited by hongkong from some other company and he was working there all the years before moving to india.
Transferred to india entity was on us payroll - gratuity eligibility?
Here is my case: i started in usa for a company abc inc on 21st january 2008. in 2011 i was transferred to india entity of the abc inc which is abc india pvt ltd. i came to india and started working from 8th febuary 2011 but was on us payroll till may 31st 2011. my india payroll started from june 1st 2011. now i am being transferred back to same us company on september 1st. will i be eligible for the gratuity? should i resign before leaving? or should i wait?

Hi i am working in an it department for a leading media company located in mumbai india. i had joined it in jul 2008 till date 31 oct 2013 i.e. 5 years 3 months 16 days i am about to get transferred to the sister company of the same organization/group a transfer letter has been provided to me for the same q1. would i be eligible to claim gratuity form my current company or would i can claim gratuity post resigning the organization/groups completely. q2. both the sister company\'s hr with the corporate hr are playing ping pong with me when questioned on my gratuity status also the company have never paid gratuity to any employee who has redesigned is eligible as no one has never asked for it. so i would like to know my way forward in this.
Gratuity for overseas transfer
Hi i worked for a company in india from jan 2005 to dec 2011. from sep 2009 to jan 2009 4 months i was transferred to uk location of the group company on intracompany transfer workpermit visa. i worked till jan 2009 and again moved back to india to the parent company. when i asked my company about the gratuity amount they are saying i am not eligible for the gratuity as i don t have continous 5 years of service in india. i am feeling that i would be eligible for gratuity as i have served the company for more than 6 years 6 years 7 months from india location. please let me know 1. am i eligible for gratuity at all? 2. if i am eligible would i be paid gratuity only for my india service? thanks kumaresh
