Our organization is manufacturing Medical Equipments, currently we have Factory License under Factory Act 1948. Now we would like to expand our 100 more employees in Sales Branch Offices in PAN India for Sales and after Sales services (Not Manufacturing).
Please let us know can we register under Shop & Established Act 1961 and also can we transfer our old R&D employees who are already covered under Factory Act 1948, as they are not coming under manufacturing process. And also let us know the same organization can be registered under both Act (Shop & Established Act and Factory Act 1948).

Dear Mittal,
I think yours must be a Company registered under the Companies Act. Under such single registration, it can have separate units of different activities such as manufacturing, Marketing or sales subject to a common accounting system. In such a case, the registration of any such unit would be under the particular establishment -specific labor law applicable only as per its concerned predominant activity.
