Can company change employee Handbook/HR Policy at any point of time?
From India, Pune
An employee handbook or HR policy manual has no legal sanctity unlike a Standing Order. A clause in the Certified Standing Order can be changed only with the approval of the signatories of the standing order like workers' representatives, Trade Union office bearers, labour department official etc and that also after following certain formalities. In the case of HR manual a communication to the effect that such and such clause has been repealed and such and such things have been added would be enough. Anyway, without communicating the changes, you should not make any change in it. It can be questioned by the employees and a complaint made by an employee coming under the purview of Industrial Disputes Act will be maintainable also. Therefore, before amending the Policy be careful because anything in the HR Manual which is against the law is illegal.
